What is TCPA?

Since 1991, the Federal Telephone Consumer Protection Act (TCPA) has protected consumers from unsolicited telephone marketing, including unwanted – and potentially costly – calls and text messages to their wireless telephones. A more recent 2013 FCC rule brought the potential for large fines for violators, while a 2015 FCC ruling broadened the scope of affected calls to include those originating from many forms of modern automated telephone equipment.

TCPA compliance now requires explicit consent for automated calls containing marketing content, including so-called “dual purpose” calls involving other business purposes. Penalties are particularly harsh for sending unsolicited automated calls or text messages to wireless devices without consent.
