Service Objects will offer EU and Swiss individuals whose personal information has been transferred to us the opportunity to choose whether the personal information it has received is to be used for a purpose other than the purpose for which it was originally collected or subsequently authorized by the individual. Service Objects employs appropriate mechanisms for cross-border transfers of personal data, as required by applicable local law. Service Objects complies with the EU-U.S. Privacy Shield Framework and the Swiss – U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union and Switzerland to the United States, respectively. Service Objects has certified to the Department of Commerce that it adheres to the Privacy Shield Principles. If there is any conflict between the terms in this privacy policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Unless you are in EEA or Switzerland, if you have a dispute with us relating to our data protection practices, please contact us by emailing privacy@serviceobjects.com. If we can’t resolve the dispute through those channels, please see Section 9 of our Master Services Agreement, which describes how disputes will be resolved between us. As described in that section, the American Arbitration Association (http://www.adr.org/) will conduct the dispute resolution proceedings. Please be sure to review our Terms of Service, including Section 9, before you use any of our products and services.
For individuals in the EEA or Switzerland, you have additional rights to make a complaint to a competent data protection authority or commence proceedings in a court of competent jurisdiction in accordance with applicable data protection laws. Service Objects has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the ICDR-AAA Privacy Shield Program, operated by the American Arbitration Association, an alternative dispute resolution provider located in the United States, to address complaints and provide appropriate recourse free of charge to the individual. If You do not receive timely acknowledgment of Your complaint from us, or if we have not resolved Your complaint, please contact or visit http://go.adr.org/privacyshield.html for more information and to file a complaint. The services of the ICDR-AAA Privacy Shield Program are provided at no cost to You.
Service Objects’ liability for personal data of EEA or Swiss individuals that it receives under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, Service Objects remains responsible and liable under the Privacy Shield Principles if a third-party agent that it engages to processes the personal data on its behalf do so in a manner inconsistent with the Principles, unless Service Objects proves that it is not responsible for the event giving rise to the damage.
Service Objects is subject to the investigatory and enforcement powers of the Federal Trade Commission (“FTC”), or any other U.S. authorized statutory body. The FTC has jurisdiction over Service Objects compliance with the Privacy Shield.
In some circumstances, EEA or Switzerland individuals may invoke binding Privacy Shield arbitration as a last resort if all other forms of dispute resolution have been unsuccessful. See https://www.privacyshield.gov/ for more information about this process. The place of arbitration shall be the United States, and in person participation will not be required. Irrespective of the outcome of arbitration, each party shall bear its own attorneys’ fees. The arbitrator(s) has the authority to impose individual-specific, non-monetary equitable relief necessary to remedy any violation of the Privacy Shield Principles only with respect to the individual.
